Al Ain court orders bank to return Dh40,000 sent to inactive account by mistake
A court in Al Ain has ordered the return of Dh40,000 that was accidentally transferred to an inactive bank account, ruling that no legal basis existed for the transaction.
The case involved a woman who had mistakenly sent the sum to a man’s account. The court determined there was no contractual relationship or debt that justified the transfer, and authorised the bank to recover the money on her behalf.
Bank statement confirms funds untouched
In its ruling, the court noted that the bank’s records showed the Dh40,000 had been transferred from the plaintiff’s account and credited to the defendant’s account. The amount remained in the account, with the only deductions being periodic fees charged by the bank. The defendant had not withdrawn, transferred, or otherwise disposed of the funds.
Court authorises recovery
Based on the evidence, the court concluded that the transfer was made in error and that the defendant had no entitlement to the money. It instructed the bank to reverse the transaction and return the full amount to the woman who had sent it.
