Al Ain court rejects Dh20,000 compensation claim against woman over criminal complaint
A court in Al Ain has dismissed a man’s claim for Dh20,000 in compensation from a woman after she filed a criminal complaint against him.
Court Ruling
The Al Ain Court of First Instance ruled that the documents submitted in the case did not provide evidence proving that the woman’s complaint was false or that she had deliberately intended to harm the plaintiff.
The court further stated that it was not established that the woman’s recourse to the authorities was characterised by bad faith or gross error, nor that she had abused her right to report by making allegations she knew to be untrue.
Insufficient Evidence
The judgment emphasised that the lack of sufficient evidence in a criminal case does not, by itself, demonstrate that a complaint was false or that the complainant misused her right to file a report.
The man had sought compensation from the woman, arguing that her criminal complaint against him had caused him damage. However, the court found no basis to support his claim and dismissed the case.
